These Terms explain how to use WitHop, the limits of AI-assisted practice, and what happens when you subscribe, cancel, or delete your data.

01Agreement and operator

These Terms govern your use of WitHop and related services operated by WitHop (“WitHop,” “we,” or “us”). Contact: lifeline2023@outlook.com.

Terms: WitHop.speakai.top/terms
Privacy Policy: WitHop.speakai.top/privacy

By accepting these Terms or using the service in circumstances where a binding agreement may lawfully be formed, you agree to these Terms. If you cannot lawfully enter this agreement yourself, a parent, guardian, or other authorized representative must do so where required. Mandatory consumer and privacy rights always prevail over inconsistent wording here. The Privacy Policy explains data handling; accepting these Terms does not grant consent to optional processing.

02Eligibility and children's use

WitHop is intended to support users of different ages, subject to applicable law, app-store availability, and age-appropriate feature restrictions. An app-store age rating is not parental consent or permission to process children's data.

Users below the legal age to enter an agreement or authorize relevant data processing need the authorization required by their jurisdiction. Connected AI and other data-processing features may be restricted until required age assurance and parental authorization are completed. Provider restrictions may be stricter: parental authorization does not permit access that an AI provider prohibits. Under the standard Gemini API terms reviewed for this draft, an app directed toward or likely to be accessed by users under 18 cannot use that service. An all-age WitHop release must therefore use a service or contractual arrangement that permits its actual audience, or keep the incompatible integration unavailable. Purchases by minors require appropriate authorization and platform controls. We do not waive legally required parental consent because a user claims to be older.

Parents and guardians should supervise age-appropriate use, discuss the limits of AI, and use platform purchase and content controls. We may restrict unsafe features, investigate child-safety reports, and take action required by law. Child-safety and privacy requests can be sent to our contact email.

03What the service offers

WitHop provides everyday scenario practice, thinking exercises, brain games, and progress tracking. AI-assisted features, when offered in the released version, help you explore responses to work, social, study, and life situations. Features, languages, access limits, and paid entitlements are described in the app before purchase.

Some features may operate locally or use prewritten content. A feature is not a live AI conversation merely because it includes the WIT coach. The identified prospective AI providers are OpenAI and Google Gemini, subject to the actual service contract, regional availability, and age restrictions. Before sharing personal information with an external AI provider, we identify the recipient and purpose and ask for your explicit permission. You can withdraw your permission for future transfers through the available privacy controls or by contacting us. We do not promise that all listed providers are available to every user. Features described as forthcoming are not included until released.

04AI and training limitations

AI may produce inaccurate, incomplete, biased, unsuitable, or unexpected content. Consider the context, verify important information, and use your own judgment before acting. Generated content may be similar to content provided to others and is not guaranteed to be unique or eligible for intellectual-property protection.

WitHop is for education, practice, recreation, and self-reflection. It is not medical care, psychotherapy, crisis support, legal advice, financial advice, or a professional diagnosis. Scores, feedback, strengths, estimated brain-age labels, and progress reports describe app activity or model estimates; they do not establish intelligence, biological age, a health condition, or guaranteed improvement in real-world outcomes.

Do not use the service to make employment, education, credit, insurance, medical, or other consequential decisions about people. Do not rely on it in an emergency. Seek appropriate professional or local emergency assistance when needed. Messages are not continuously monitored for emergencies.

05Your responsibilities and acceptable use

Use the service lawfully and respect others' rights. Do not submit content you lack permission to use, another person's confidential information, or unnecessary sensitive personal information. Use fictional details for practice where possible.

You must not use the service to exploit or sexualize children; facilitate violence, abuse, discrimination, fraud, stalking, or self-harm; distribute malware; impersonate others deceptively; bypass consent or safety measures; access someone else's records; or interfere with service security. We may refuse or limit abusive requests and investigate misuse in a proportionate way.

Do not copy, resell, or commercially exploit the app beyond your license. Restrictions on reverse engineering, interoperability, research, and security testing apply only to the extent permitted by applicable law. Nothing restricts nonwaivable statutory rights or lawful reporting to authorities.

06Your content and our materials

You retain rights you hold in information and content you submit. You grant us a limited, nonexclusive license to process that content only as needed to provide your requested features, maintain necessary safety and security, and comply with law, consistent with the Privacy Policy. This is not a blanket license to publish your private scenarios, use them in advertising, or train models.

WitHop and its licensors retain rights in the app, WIT character, designs, software, and other protected materials. We grant you a personal, limited license to use the service on compatible devices in accordance with these Terms and applicable app-store rules. Rights in AI output are subject to applicable law and third-party rights; we do not promise ownership of material that cannot legally be owned.

07Records and deletion

The current version stores training records locally and does not require a registered server account. Protect your device. Clearing app storage, deleting records, uninstalling, or changing devices can cause data loss. Device or platform backups may behave differently, and we do not promise cloud synchronization unless expressly offered.

To remove local records, open Settings > Delete Account > Confirm Delete. If deletion fails, retry or contact support. If cloud accounts become available, their account-deletion flow must also address associated server and processor records as described in the Privacy Policy. You can request deletion without first canceling a subscription.

Deletion or uninstalling does not cancel an app-store subscription. Subscription cancellation and privacy deletion are separate actions. See Section 9.

08Free access and WitHop PRO

The app may include free features with usage limits and optional PRO access. Planned PRO benefits include AI scenario training, access to all training games, unlimited in-app training energy, and Brain Index assessment reports, subject to the specific entitlement disclosure at purchase. “Unlimited energy” refers to the virtual energy system; it does not promise unlimited AI requests, uninterrupted service, or exemption from disclosed safety or capacity limits. Any AI quotas must be stated before purchase.

Initial assessments and previously obtained results are described as free in the reviewed build. No ads are currently shown to any users in that build, so absence of ads is not an exclusive paid benefit. Do not infer additional benefits from promotional examples.

The reviewed version has demonstration membership and no connected store payment. Demo activation does not charge, start a paid trial, or automatically renew. Real billing terms below apply only once actual store products are offered and confirmed by you through the store.

09Subscription billing and cancellation

Where offered, PRO subscriptions may be weekly or annual. The app and store purchase sheet display the actual localized total price, currency, billing period, included benefits, and any eligibility conditions before purchase. No lifetime plan is offered by these Terms.

Payment is charged to the Apple Account used to confirm the purchase. Auto-renewable subscriptions renew for the displayed period unless canceled before renewal in accordance with the store's cancellation deadlines. For Apple subscriptions, cancel at least 24 hours before the current period ends; Apple may charge renewal within the 24 hours before that period ends. A free or discounted trial exists only if expressly shown in the purchase sheet, with its duration and subsequent charge. Cancel a trial before the stated deadline to avoid the displayed paid renewal.

On iPhone, manage or cancel through Settings > your name > Subscriptions > WitHop. Cancellation normally stops future renewals; access ordinarily continues through the paid period, subject to platform rules, including rules for trials. Use the restore-purchases control with the appropriate Apple Account where available. Contact support if an entitlement is missing; do not repeatedly repurchase to restore access.

Prices and offers can vary by country, currency, tax, and eligibility. An annual plan charges its full annual total; a weekly equivalent is informational and is not a weekly billing option. Introductory offers must state their length and subsequent renewal price. Price changes follow applicable notice and consent requirements and platform rules.

Apple handles requests for refunds on Apple-billed purchases, including through reportaproblem.apple.com. Refunds, withdrawal rights, and remedies remain subject to applicable law and platform rules. Nothing here imposes a blanket no-refund rule or waives mandatory rights. Immediate supply of digital content does not by itself waive an applicable withdrawal right; any legally required acknowledgment and express consent must be obtained separately.

10Virtual items and rewards

Coins, energy, streak shields, and revival passes are virtual items for app use. They are not money, deposits, investments, or transferable cash balances. Their use, availability, and any price are disclosed in the app. Earned rewards and any paid items must be distinguished accurately. We do not remove legally protected purchase rights by calling an item virtual. Changes to paid items or discontinued access are subject to applicable consumer remedies.

11Updates and service changes

We may provide updates, improve features, or change the service for legitimate operational, legal, or safety reasons. We provide required notices and remedies for material adverse changes to purchased services. We will not retroactively remove mandatory rights or treat continued use as consent when express agreement is required. Where applicable, you may terminate affected services and seek a proportionate refund or other legal remedy.

12Restriction and termination

You may stop using WitHop at any time and request deletion. We may restrict access for serious misuse, security risks, or legal requirements. Where feasible and lawful, we give a reason and an opportunity to resolve or challenge a restriction by contacting support. Urgent safety or legal action may occur without advance notice. Termination does not automatically settle billing or eliminate statutory refund rights.

13Warranties and liability

We aim to provide the service with reasonable care and skill. To the extent permitted by law, we do not guarantee error-free AI output, uninterrupted availability, or a particular personal outcome. Your mandatory rights to conformity, reasonable quality, repair, replacement, refunds, and other remedies remain intact.

To the extent permitted by law, we are not responsible for unforeseeable losses, losses caused solely by your unlawful misuse, or business losses arising from use of a consumer service. We do not exclude or limit liability for fraud, willful misconduct, gross negligence where such limitation is prohibited, death or personal injury caused by negligence, or any liability that applicable law does not permit us to exclude or limit. These Terms do not require you to indemnify us for our own wrongdoing.

14Apple platform terms

These Terms are between you and the operator, not Apple. Apple is not responsible for maintaining or supporting WitHop. To the extent required by applicable Apple licensing terms, if the app fails to meet an applicable warranty you may notify Apple, and Apple may refund the purchase price; other claims remain the operator's responsibility to the extent required by law.

The operator is responsible for applicable product, regulatory, privacy, and intellectual-property claims relating to the app, rather than Apple. You must comply with applicable third-party agreements and lawful export and sanctions restrictions. Apple and its subsidiaries are third-party beneficiaries of the applicable app-license provisions and may enforce them as permitted by the Apple agreement.

If no valid custom EULA is submitted for your storefront, Apple's Standard Licensed Application End User License Agreement applies to the app license: www.apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement that license for WitHop services without reducing mandatory rights. If a custom EULA is submitted, it must separately satisfy Apple's current minimum terms and licensed-device usage rules.

15Applicable law and disputes

We do not impose a choice of law that deprives you of mandatory consumer protections. The law applicable to a dispute is determined by the relevant conflict-of-laws rules, including any mandatory protections in your country of habitual residence. You may bring claims in the courts available under applicable consumer law. These Terms impose no mandatory arbitration agreement or class-action waiver.

Please contact support to seek an informal resolution if you wish; doing so is not a condition for contacting a regulator or exercising a legal remedy. We do not claim that any obsolete or unavailable online dispute platform is a required route.

16Changes and contact

We publish updated Terms with the revision date and provide advance notice or obtain agreement where required. Material changes do not retroactively alter accrued rights. If a provision is unenforceable, the remaining provisions apply only to the extent lawful.
